ORDINANCE No. 1278

AN ORDINANCE AMENDING CHAPTER 16, ARTICLE I OF THE LAMAR MUNICIPAL CODE TO ADOPT THE “INTERNATIONAL PROPERTY MAINTENANCE CODE, 2018 EDITION” WITH AMENDMENTS

WHEREAS, Colorado Revised Statutes § 31-15-401 grants general police powers to the City Council to promulgate ordinances for the health, safety and welfare of the public; and

WHEREAS, the International Code Council, Inc has issued a 2018 edition of the International Property Maintenance Code, and

WHEREAS, the City Council of the City of Lamar, Colorado desires and has determined that it is in the best interest of the health, safety and welfare of the inhabitants of the City to adopt the 2018 edition of the International Property Maintenance Code, with amendments, for application within corporate limit of the City of Lamar, Colorado and for application to property owned by the City outside the City’s corporate limits.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAMAR, COLORADO:

Part 1: The Lamar Municipal Code, CHAPTER 16, Article I, Sec. 16-1 is hereby repealed in its entirety and replaced, which reads as follows:

Sec. 16-1. Adoption.

Pursuant to C.R.S. § 31-16-201 et seq., there is adopted as the property maintenance code of the City, by reference thereto, the International Property Maintenance Code, 2018 Edition, together with all appendices and tables thereto, published by the International Code Council, Inc. 500 New Jersey Ave NW, 6th Floor, Washington D.C. 20001 that code to have the same force and effect as if set forth in the Article in every particular, save and except such portions as are added, amended, deleted, or replaced in the Article.

Part 2: The Lamar Municipal Code, CHAPTER 16, Article I, Sec. 16-3 is hereby repealed in its entirety and replaced, which reads as follows:

Sec. 16-3. Amendments.

  1. The code adopted herein is hereby modified by the following amendments:

  2. Section 101.1, Title is amended by inserting “the City of Lamar”.

  3. Section 102.3, Application of Other Codes, is amended by:

  4. Replacing “International Zoning Code” with “Lamar Zoning Code”.

  5. Section 103.5, Fees, is amended by inserting “As established by the City of Lamar”.

  6. Section 104.4, Identification, is deleted in its entirety.

  7. Section 111.2, Membership of Board, is amended by replacing “three” with “five” as the minimum number of members.

  8. Section 111.2.5, Compensation of Members, is deleted in its entirety.

  9. Section 302.4, Weeds, is amended by inserting “12 inches” as the allowable height of weeds.

  10. Section 304.14, Insect Screens, is amended by the insertion of “April 15” and “September 15”.

  11. Section 602.3, Heat Supply, is amended by inserting “October 1” to “May 1”.

  12. Section 602.4, Occupiable Work Spaces, is amended by inserting “October 1” to “May 1”.

  13. The accumulative supplement to the International Property Maintenance Code is hereby adopted within the City.

Repealer. All ordinances, resolutions, bylaws and regulations of the City in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency. This repealer shall not be construed to revive any ordinance, resolution, bylaw or regulation, or part thereof, heretofore repealed.

Severability. If any section, paragraph, clause or provision of this Ordinance shall be held invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any other provision of this Ordinance.

Effective Date. This Ordinance shall be in full force and effect 30 days after publication following final passage and adoption.
