AN ORDINANCE OF THE CITY OF LAMAR, COLORADO ZONING THE PROPERTY KNOWN VALCO SUBDIVISION LOT 1; ALSO KNOWN AS, A PORTION OF THE NE ¼ OF THE SE ¼ OF SECTION 30 AND A PORTION OF THE NW ¼ OF THE SW ¼ OF SECTION 29, TOWNSHIP 22 SOUTH, RANGE 46 WEST OF THE SIXTH PRINCIPAL MERIDIAN, PROWERS COUNTY, COLORADO, AS DESCRIBED ON THE PLAT, RECORDED UNDER RECEPTION NUMBER 527423, IN THE OFFICE OF PROWERS COUNTY CLERK AND RECORDER, TO THE CITY OF LAMAR, COLORADO, TO HIGHWAY SERVICE DISTRICT (C-3).
WHEREAS, the City of Lamar, Colorado (“City”) is a Home Rule Municipal Charter of the State of Colorado, duly organized and operating under the constitution and laws of the State of Colorado; and
WHEREAS, the annexation petition was accepted by the City by passage of Resolution 26-08-01 on August 24, 2026; and
WHEREAS, proper application was made to the Planning & Zoning Commission of the City of Lamar, Colorado for Valco Subdivision Lot 1 to be zoned as a Highway Service District (C-3) Zone District and the Planning & Zoning Commission recommended approval on August 12, 2026; and
WHEREAS, the owners have requested that the property be initially zoned Highway Service District (C-3) upon annexation; and
WHEREAS, the City Council has reviewed the zoning application and agrees with the Planning & Zoning Commission’s findings; and
WHEREAS, the Lamar City Council has held a duly noticed public hearing on October 12, 2026, as required by the Lamar Municipal Code and now wish to zone the property to Highway Service District (C-3).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAMAR, COLORADO:
Section 1. The aforementioned recitals are hereby fully incorporated herein.
Section 2. That the Property, known as Valco Subdivision Lot 1 and more particularly described as: a portion of the NE ¼ of the SE ¼ of Section 30 and a portion of the NW ¼ of the SW ¼ of Section 29, Township 22 South, Range 46 West of the sixth principal meridian, Prowers County, Colorado, be and hereby is, annexed to the City of Lamar and made a part of the corporate limits of the City of Lamar, Colorado, shall be zoned as Highway Service District l (C-3) Zone District.
Section 3. Within thirty (30) days after the effective date of this Ordinance, the City Clerk shall incorporate the terms of this Ordinance on the Official Zoning Map described LMC 30-16 and shall cause a printed copy of the amendment to the City Zone District Map to be made, which shall be dated and signed by the Mayor and attested to by the City Clerk and which shall bear the seal of the City. The amended Map shall include the number of this Ordinance. The signed original printed copy of the Zoning Map shall be filed with the City Clerk. The Clerk shall also record a certified copy of this Ordinance with the Prowers County Clerk and Recorder. The City staff is further directed to comply with all provisions of the Lamar Municipal Code, LMC §30-16, to implement the provisions of this Ordinance.
Repealer. All ordinances, resolutions, bylaws and regulations of the City in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency. This repealer shall not be construed to revive any ordinance, resolution, bylaw or regulation, or part thereof, heretofore repealed.
Severability. Should any one or more sections or provisions of this Ordinance be judicially determined invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining provisions of this Ordinance, the intention being that the various sections and provisions are severable.
Effective Date. This Ordinance shall be in full force and effect 30 days after publication following final passage and adoption.
