ORDINANCE NO._____________

AN ORDINANCE VACATING A PORTION OF MULLEN STREET BETWEEN LOTS 3 AND 4 IN BLOCK 2 IN FIRST SUBDIVISION OF J.W. BENT’S COTTAGE PLACE ADDITION ALSO KNOWN AS 700 EAST BEECH STREET; AND LOTS 1, 2 AND 3 IN BLOCK 3 IN FIRST SUBDIVISION OF J.W. BENT’S COTTAGE PLACE ADDITION ALSO KNOWN AS 701 EAST BEECH STREET CITY OF LAMAR, COUNTY OF PROWERS, STATE OF COLORADO.

WHEREAS, proper application has been made to the Planning and Zoning Commission of the City of Lamar, Colorado for the vacating of a portion of Mullen Street that runs perpendicular to East Beech Street. See attached map. Proper application has been made to the Planning and Zoning Commission of the city of Lamar, Colorado to vacate a portion of Mullen Street, between Lots 3 and 4 in Block 2 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 700 East Beech Street; and Lots 1,2 and 3 in Block 3 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 701 East Beech Street.

WHEREAS, the Planning and Zoning Commission held a public hearing on the application, pursuant to proper, timely and legally sufficient public notice, posting, and publication; and

WHEREAS, the Planning and Zoning Commission has recommended to the City Council for vacating a portion Mullen Street that runs perpendicular to East Beech Street. See attached map. Proper application has been made to the Planning and Zoning Commission of the city of Lamar, Colorado to vacate a portion of Mullen Street, between Lots 3 and 4 in Block 2 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 700 East Beech Street; and Lots 1,2 and 3 in Block 3 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 701 East Beech Street.

NOW THEREFORE, be it ordained by the City Council of the City of Lamar, Colorado:

  1. That the following described Mullen Street, between Lots 3 and 4 in Block 2 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 700 East Beech Street; and Lots 1,2 and 3 in Block 3 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 701 East Beech Street., be and is hereby vacated:

Mullen Street, between Lots 3 and 4 in Block 2 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 700 East Beech Street; and Lots 1,2 and 3 in Block 3 in First Subdivision of J.W. Bent’s Cottage Place Addition also known as 701 East Beech Street.

  1. The City does hereby reserve and retain, for itself and all other public utility service providers, all necessary rights-of-ways or easements for the continued or future use of existing sewer, gas, water or similar pipelines and appurtenances, for ditches or canals and appurtenances, and for electric, telephone, telecommunication, and similar lines and appurtenances, including television and communications, all as provided in C.R.S. §43-2-303(3).

  2. The City Clerk and the GIS office are hereby directed to make all necessary changes on the official map of the City of Lamar in respect to the above and foregoing ordinance.
