AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAMAR REPEALING AND REPLACING CHAPTER 30 FOR ZONING REGULATIONS OF THE MUNICIPAL CODE
WHEREAS, Colorado Revised Statutes § 31-15-401 grants general police powers to the City Council to promulgate ordinances for the health, safety and welfare of the public; and
WHEREAS, the City of Lamar, Colorado (“City”) is a Home Rule Municipal Charter of the State of Colorado, duly organized and operating under the constitution and laws of the State of Colorado; and
WHEREAS, the City of Lamar’s City Council directed the Planning and Zoning Commission to complete a comprehensive update to Chapter 30, zoning regulations, to promote the future development of the City in accordance with the adopted 2025 Comprehensive Plan; and
WHEREAS, the City Council is desirous of amending the zoning regulations in Chapter 30 and complying with CRS 29-32-104 Colorado’s Proposition 123 expedited review requirements; and
WHEREAS, the City of Lamar Planning Commission held a public hearing on September 17, 2025 and recommended repealing Chapter 30 Zoning and replacing it with the recommended code updates attached herein as Exhibit A.
WHEREAS, the City Council has determined that it is in the best interest of health, safety, and welfare of the inhabitants of the City to exercise its express authority to repeal and replace Chapter 30 zoning regulations in compliance with Proposition 123.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAMAR, COLORADO, AS FOLLOWS:
Section 1. The Lamar Municipal Code, Chapter 30 Zoning, is hereby repealed and replaced with Exhibit A Chapter 30 Zoning.
Section 2. The Lamar Municipal Code, Chapter 2, Article VI, Division – 9 Lamar Historic Preservation Advisory Board Sections 2-359, 2-361, 2-362, 2-363, 2-364, 2-365, and 2-366 of the Lamar Municipal Code are hereby repealed and replaced as incorporated into Exhibit A Chapter 30 Zoning.
Section 3. Pursuant to the City of Lamar Home Rule Charter Section 5-4 and 5-9, the City Council for the City of Lamar, determines that any publication for this ordinance shall be published by reference in accordance with said Sections.
Section 4. Severability. If any section, sentence, clause, phrase, word or other provision of this ordinance is for any reason held to be unconstitutional or otherwise invalid, such holding shall not affect the validity of the remaining sections, sentences, clauses, phrases, words or other provisions of this ordinance, or the validity of this ordinance as an entirety, it being the legislative intent that this ordinance shall stand notwithstanding the invalidity of any section, sentence, clause, phrase, word or other provision.
Section 5. Savings Clause. Except as amended hereby, the Lamar Municipal Code, as amended, shall remain valid and in full force and effect. Any provision of the Code that is in conflict with this ordinance is hereby repealed as of the effective date hereof.
