AN ORDINANCE REZONING CERTAIN LOTS WITHIN THE TOWN OF CHEYENNE WELLS, COLORADO, FROM RESIDENTIAL TO A MULTI-RESIDENTIAL DUPLEXES
WHEREAS application was made on or about April 10, 2026 to rezone the following described real property from residential to a multi-residential tiny homes warranty deed reception #250211.
The South Half (S l/2) of lot seven (7) and of Lots Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), in Block One (1), in the First Addition to the Town of Cheyenne Wells, Cheyenne County, Colorado, TOGETHER WITH a tract or parcel of land with is a portion of West 2nd Street, (formerly Walnut Street) in the Town of Cheyenne Wells, Cheyenne County, Colorado, adjacent thereto, which tract or parcel having been heretofore vacated by the Town of Cheyenne Wells by Ordinance No. 234, dated July 9, 2002 and recorded July 10, 2002 as Reception No. 221116 of the Cheyenne County, Colorado Records being more particularly described as follows: Beginning at a point on the easterly boundary line of said Block 1, which point is twelve feet and one-half (12 ½') north of the southeast corner of Lot 7, in said Block 1, thence southerly along the easterly boundary of said Block 1 a distance of one hundred thirty-seven and one-half feet (137 ½'), more or less, to the Southeast corner of Lot 12, in said Block 1; thence easterly along the southerly boundary line of said Block 1, extended easterly, a distance of twenty feet (20'); thence northerly along a line parallel with and 20 feet distant easterly from the easterly boundary of said Block 1 a distance of one hundred thirty-seven and one-half feet (137 ½'), to a point; thence westerly to the point and place of beginning

And WHEREAS, C.R.S. 31-23-304 and 305, along with section 8-101 of the Cheyenne Wells Ordinance, provide for and permit amendments to zoning designations, subject only to compliance with certain procedures which have been complied with, as more fully recited below, and
WHEREAS notices of hearing on the rezoning application were published on April 24 and May 1, 2026 in the newspapers -Kiowa County Press & Kiowa County Independent in general circulation of Eads, Colorado for general circulation for Cheyenne Wells residence, and
WHEREAS written notices of said public hearings were given to all owners of land located within 200 feet of the property which was subject to the rezoning application, said notices having been duly mailed on April 23, 2026 by depositing 1he same in the United States postal system, postage prepaid for first class mail delivery, and
WHEREAS no objections to the rezoning application were filed prior to the respective hearings, and
WHEREAS the said Board of Trustees has and does hereby determine that the rezoning application ought to be granted,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CHEYENNE WELLS, AS FOLLOWS:
SECTION 1. REAL PROPERTY REZONED. The following real property is hereby rezoned from residential to multi-residential tiny homes

SECTION 2. EFFECTIVE DATE. The Board of Trustees of the Town of Cheyenne Wells, State of Colorado, hereby finds, determines and declares that an emergency exists, and this ordinance is necessary for the immediate preservation of the public peace, health, and safety and shall be in full force and effect upon its adoption. It is provided, however, that if this ordinance is adopted by an affirmative vote of !ess than three-fourths of the members of the Board of Trustees, it shall take effect and be in force thirty days after its final passage, approval, and publication as provided by law.
