ORDINANCE 292

AN ORDINANCE PROVIDING FOR THE REPEAL OF ORDINANCE NUMBER 230 AND DISSOLVING THE NORTH 2nd STREET WEST SPECIAL IMPROVEMENT DISTRICT (“THE DISTRICT”)

WHEREAS, the Town of Cheyenne Wells (“Town”) is a statutory municipality duly organized and existing under the Colorado Revised Statutes (“CRS”) Title 31. CRS Title 31, Chapters 25 and 26 provide the authority for local government to establish improvement districts, the method for organization thereof, and the processes and powers of such districts: CRS 31-25-625 specifies that districts may be dissolved after notice is given and a hearing is held by the governing body on the matter. CRS 31-25-625 requires that a district shall be dissolved after it has satisfied or paid in full all of its outstanding indebtedness, obligations and liabilities: or until funds are on deposit and available therefore.

WHEREAS, Ordinance 230 created the District for the purpose of financing the construction of certain special improvements, consisting of street improvements within the Town of Cheyenne Wells; and

WHEREAS, certain property specifically benefitted by the improvements and included within the District was assessed with the cost of the improvements; and

WHEREAS, all assessments of the cost of improvements authorized and ordered by Ordinance 230 have been duly paid by the property specifically benefitted by the improvements; and

WHEREAS, since the purpose of the District was to finance the cost of improvements authorized and ordered by Ordinance 230, and this purpose has been fulfilled; and

WHEREAS, notice of a hearing on the proposal to dissolve the District has been given by publication within the District at least twenty days prior to the date of the hearing; and

WHEREAS, the District has satisfied or paid in full all of its outstanding indebtedness, obligations, and liabilities; and

WHEREAS, it is now appropriate to dissolve the District;

NOW, THEREFORE, be it ordained by the Town of Cheyenne Wells, Colorado that:

SECTION 1. Ordinance 230 is repealed in its entirety.

Section 2. Dissolution of the District. North 2nd West Street Special Improvement District is dissolved.

Section 3. Public Inspection. Copies of this ordinance is available for public inspection at the office of the Cheyenne Wells Town Clerk.

Section 4. Public Hearing. A public hearing on this Ordinance shall be held on the 8th day of September 2026, at 6:00 pm in the Town of Cheyenne Wells Council Chambers of the Municipal Complex 151 South 1st, Cheyenne Wells, Colorado.

Section 5. Effective Date. This Ordinance shall become effective as a permanent Ordinance five (5) days after publication, following final adoption after a public hearing held on the 8th day of September, 2026.

Section 6. Severability. If any portion of this Ordinance is found to be void or ineffective, it shall be deemed severed from this Ordinance and the remaining provisions shall remain valid and in full force and effect.
