Kiowa County Board of Commissioners meeting minutes - April 9, 2026

The Regular meeting of the Kiowa County Commissioners was called to order on April 9, 2026, at 9:13 a.m. by Chairman Donald Oswald.
Present
- Donald Oswald, Chairman
- Howard '"Butch" Robertson, Commissioner

- Tina Adamson, County Administrator
Members of Audience
Jake Koch, Site Manager for Sand Creek Massacre National Historic Site, stopped in to meet the Commissioners and introduce himself. He has transferred from Bent’s Fort Site.
Madison Wrobley with lnvenergy was in attendance as well.
Call to Order
- Chairman Donald Oswald called to order at 9:13 a.m.
- Commissioner Oswald opened with prayer and the Pledge of Allegiance
- Commissioner Robertson moved to approve the minutes from March 26, 2026. Lening seconded. Motion carried.
- Commissioner Lening moved to approve the vouchers as presented; Robertson seconded, motion carried.
- Commissioner Lening moved to approve the agenda with the addition of a land locked property request fromRocking X Land; Robertson seconded. Motion carried.
Old Business
Grant Updates/
- Transit Building Grant: Adamson is still waiting to hear back from the state on the transit building grant. CDBG 2nd Round: Lening moved to approve the MOU between the Hospital District and Robertson seconded, motioncarried. Robertson moved to sign letter of support, Lening seconded. Motion carried.
- The DOLA REDI Grant for the KCEDF Director position Is on hold as KCEDF has not found a new director to date. Oswald updated SECED will be providing an update on possible available mini-grant funds that should beavailable soon.
Landfill / Recycling :
- Adamson will contact the county attorney to draft a purchase agreement for the land by the landfill as well as a draft for purchase of other neighboring land.
Housing: Cactus Corner
- is still delayed due to some code issues. Adamson has still not received the final inspection to get a certificate of occupancy. There has been no update on the Prop123 housing projects.
Planning & Zoning Update:
- Two Stum Subdivision Exemption applications were reviewed. Lening moved and Robertson seconded to approve bothapplications, motion carried. The Conditional Use Permits for Linly & Sherell Stum, Thunderbird Commodities LLC and Faithwalk Farms for the three RV Parks were reviewed. Lening moved and Robertson seconded to approve allthree applications, motion carried.
- The county has been contacted by several landowners who have been approached about easements for transmission lines for a possible data center. Adamson advised the county does not have regulations for data centers and we needto enact a moratorium until regulations can be developed.
- The BOCC has received a request for Impact funds from the Plainview School District and the Fire District. Nofunds will be provided at this time.
Road & Bridge:
- Robertson has received a complaint of County Road C damage, and our Road & Bridge Foremen will make a plan forrepairs. Adamson received the payment from Purple Wave auction for the equipment and vehicles that were sold In theamount of $23,010.00.
Appointments
- John Brewer, Battalion Chief with Colorado Division of Fire Prevention and Control (DFPC) met with the BOCC at10:00 a.m. He presented the mutual aid Information, listing all of the resources that could be made available to KiowaCounty upon request. John discussed the current critical fire conditions of the area and their concerns especially thelack of winter moisture. He spoke briefly about local governments adopting the Colorado Wildfire Resiliency Codeand provided a handout with Information and contacts for this.
- Audrey Johnson, Director for Social Services, met with the BOCC to give a monthly update. She stated that the areas thatthe State was going to make shared services will no longer happen so the Counties will still be doing the majority ofthose services in house.
- Russ Watson and Donna Adame presented Information regarding the Type 6 quick attack fire truck the Districtwould like to purchase. The Fire District Is requesting Impact funds for this purchase. No funding was approved atthis time.
ABATEMENT HEARING
Oswald moved and Robertson seconded to go Into an Abatement Hearing at 10:28. Motion carried. Kiowa County Assessor, Marci Miller and Landowner, Kenan Gooden, were In attendance. Miller presented information regarding abuilding owned by Gooden that was assessed as Ag but Is used for residential purposes. Assessor Miller recommended thatthe BOCC abate the 2025 taxes as the assessment rates are considerably different. Oswald moved and Lening seconded toclose the hearing and move back into the regular meeting, motion carried.
Lening moved to approve the abatement request, Robertson seconded and the motion carried. Miller updated the BOCC on an error In tax notice for Prairie Pines Assisted Living and a homestead exemption but both have been remedied. Miller and Gooden exited at 10:40 a.m.
Lening moved to recess for lunch at 11:54 a.m. The meeting resumed at 1:00 p.m.
EXECUTIVE SESSION
Donald Oswald entertained a motion to enter Into Executive Session for Personnel Matters and Attorney Consultation on 1041Regulations per C.R.S. 24-6-402 (f)(I) and (b) at 2:03. Lening moved and Robertson seconded the motion and itcarried.
Lening moved to come out of executive session and move back into regular session at 3:30. Robertson seconded and the motion carried.
INTERVIEW
The regular session was recessed at 4:40 for an interview. Jeff Scranton, Landfill Manager and Jonathan Koziol,Maintenance Supervisor, were in attendance.
Regular session resumed and Robertson moved to transfer the employee from Road & Bridge to Maintenance. Oswaldseconded and the motion carried.
New Business
- Monthly reports were handed out to the Board.
- Time-Off Requests: None
- New Hire Progress Report: None
- Two fair themes were submitted. "Celebrate Freedom Because We Are" by Areta Laird & "With Pride We Strive,With Confidence We Succeed!" by Kent Frazee
- Adamson presented the Tremcare service agreements for roofing maintenance for the Courthouse, $7,451 annually and the Bransgrove/Murdock Building, $4140 annually. Oswald moved to approve the agreements, Lening seconded. Motion carried
- A six month moratorium on permitting data centers was discussed. Mike Lening moved to approve Resolution2026-4 regarding the moratorium, Robertson seconded and the motion carried. The Moratorium is scheduled to endon October 6, 2026.
- Oswald moved and Lening seconded the motion to approve purchase of the blinds at Public Health for $2,472.Motion carried.
- The condition of the railroad crossings were discussed and the agreement by CWC Rail to Improve the crossings inexchange for not having to replace the lights and crossing arms at the town intersections was reviewed. The conditions made by the railroad have not been completed to date.
- A request from Rocking X Land to assist a land locked property owner with access was presented to the BOCC.The County Attorney advised that while the BOCC can get easements to build county roads on section lines, there has to be more than one landowner that will benefit. Otherwise, all of the landowners involved must come to an agreement and present the request to the BOCC. He advised that the landlocked property owner should consult their own attorney.

With no further business, Lening moved to adjourn at 6:10 pm; Robertson seconded. Motion carried. Next Regular Meeting: Thursday, April 29, 2026, at 9:00 a.m.
