PUBLIC NOTICE IS HEREBY GIVEN that on August 5, 2016 there was filed in the Kiowa County Combined Court a Petition entitled “Petition for Organization of the Kiowa County Fire Protection District (“District”), in the Matter of the Organization of the Kiowa County Fire Protection District. The Petition prays for the organization of a special district, pursuant to the provisions of Title 32, Article 1, Part 3, Colorado Revised Statutes. 

NOTICE IS FURTHER GIVEN that a Service Plan for the proposed District, a map and legal descriptions of areas to be included and a Resolution of the Board of County Commissions of Kiowa County, Colorado, approving the Service Plan on August 1, 2016 were also filed with the Court as required by law.  Said documents are now on file at the office of the Clerk of the Combined Court of Kiowa County, 1305 Goff Street, Eads, CO 81036 and are available for public inspection.

The purpose of the proposed District is to provide to the persons and properties within the proposed Kiowa County Fire Protection District: protection from fire to people, environment and property; to provide first responder and rescue care to sick and injured persons; to provide emergency response to hazardous materials emergencies and safeguard life, environment and property; and to provide for the safety and effectiveness of volunteer first responders through the provision of adequate training and equipment.

A general description of the land contained within the boundaries of the proposed District is as follows:  All the properties currently located within Kiowa County, Colorado according to the records of the Kiowa County Assessor.

NOTICE IS FURTHER GIVEN that by Order of the Kiowa County Combined Court, a public hearing on said Petition for Organization will be held at the hour of 2:00 p.m.

at the Kiowa County Combined Court, 1035 Goff Street, Eads, Colorado on Thursday, September 1, 2016, at which time and place any person in interest may appear if they so desire.

No later than ten (10) days before the hearing, the owner of any real property located within the proposed Kiowa County Fire Protection District may file a duly verified petition with the Court describing the property to be excluded, stating reasons why said property should not be included in the proposed District and requesting that said real property be excluded there from.

The Court shall hear said petition and all objections thereto at the time of the Hearing on the Petition for Organization of the Kiowa County Fire Protection District and shall determine whether, in the best public interest, said property shall be excluded or included in the proposed Kiowa County Fire Protection District.

In the event that the Court orders that the question of the organization of the proposed District be submitted to the electors of the proposed District, at said election the electors of the proposed District shall elect five (5) electors of the District (three from Director Districts which have the same boundaries as the current Kiowa County Commissioner’s Districts and two At Large). 

The Director Districts’ boundaries are described as follows:

District 1 within the County of Kiowa

West Boundary:  NW corner of Section 4, T17S, R46W following Sand Creek to the SW corner of Section 32, T20S, R45W of the 6^th Principal Meridian. 

South Boundary:  From SW corner of Section 32, T20S, R45W proceed East on County Road A to SE corner of Section 31, T20S, R42W of the 6^th Principal Meridian. 

East Boundary:  From SE corner of Section 31, T20S, R42W proceed North on County Road 80 to center of Section 5, T17S, R42W of the 6^th Principal Meridian. 

North Boundary:  From the center of Section 5, T17S, R42W proceed West on County Road BB to NW corner of Section 4, T17S, R46W of the 6^th Principal Meridian.

District 2 within the County of Kiowa

West Boundary:  NW corner of Section 2, T17S, R51W following County Road 2 South to the SW corner of Section 35, T20S, R51W of the 6^th Principal Meridian. 

South Boundary:  From SW corner of Section 35, T20S, R51W proceed East on County Road A to SE corner of Section 31, T20S, R46W of the 6^th Principal Meridian. 

East Boundary:  From SE corner of Section 31, T20S, R46W following Sand Creek North to the NE corner of Section 5, T17S, R46W of the 6^th Principal Meridian. 

North Boundary:  From the NE corner of Section 5, T17S, R46W proceed West on County Road BB to NW corner of Section 2, T17S, R51W of the 6^th Principal Meridian.

District 3 within the County of Kiowa

West Boundary:  NW corner of Section 6, T18S, R54W South to the SW corner of Section 31, T19S, R54W East to the NW corner of Section 6, T20S ,R54W proceed South to the SW corner of Section 31, T20W, R54W of the 6^th Principal Meridian. 

South Boundary:  From the SW corner of Section 31, T20W, R54W proceed East on County Road A to SE corner of Section 34, T20S, R51W of the 6^th Principal Meridian. 

East Boundary:  From SE corner of Section 34, T20S, R51W proceed North on County Road 23 to NE corner of Section 3, T17S, R51W of the 6^th Principal Meridian. 

North Boundary:  From the NE corner of Section 3, T17S, R51W proceed West on County Road BB to NW corner of Section 6, T17S, R51W proceed South on County Road 19 to SW corner of Section 31, T17S, R51W proceeding West on County Road V to NW corner of Section 6, T18S, R54W of the 6^th Principal Meridian.

Two of the original directors will be elected At Large and are to serve until they, or they successors, are elected and qualified at the next regular election occurring in May 2018.  Three of the original directors will be elected from Director Districts and are to serve until the next regular election occurring in May 2020. The candidates for Board Directors may be nominated by Self Nomination and Acceptance forms, filed with Tina Adamson, DEO, 1305 Goff St., Eads, CO 81036 no later than noon on August 24, 2016.  The DEO will then file the Self Nomination forms with the Court on or before August 29, 2016. 

Any Self-Nomination and Acceptance form so filed shall designate the name of each nominee, the Director District or At Large nomination, and the term for which nominated and shall state that the nominee is an elector of the proposed District (and Director District if applicable) and that the elector shall consent to serve the term designated in the Self Nomination and Acceptance form. No nomination form shall designate any person as a candidate for more than one office, nor shall it place in nomination more names than the number of offices to be filled, nor shall it designate more than one nominee for each office to be filled.  No elector shall witness and sign a Self Nomination and Acceptance form for more than one person for any one office to be filled. Those elected shall constitute the Board of Directors of the District, if organized. 

Self-Acceptance and Nomination forms for Directors are available at the Kiowa County Court House, Board of County Commissioners’ office, 1305 Goff Street, Eads, CO 81036, Colorado.  Completed forms shall be returned to Tina Adamson, DEO, 1305 Goff Street, Eads, CO 81036 by noon on August 24, 2016.
